Red Hat Agreements

To access a Red Hat portal and Red Hat Content, you must be a current customer of Red Hat or its affiliates – in other words, you must have active subscriptions valid under the terms of a support subscription agreement (such as the Red Hat Enterprise Agreement) between you and Red Hat and/or a Red Hat („Customer Agreement“). Your access and use of Red Hat content is subject to these Terms of Use and your customer agreement. Some Red Hat Content may include additional terms, licensing agreements, confidentiality terms, export terms, subscription contracts or other terms and conditions applicable to your access or use of the corresponding Red Hat content. In the event of a conflict, inconsistency or difference between these Terms of Use and the Additional Conditions, the additional conditions will be monitored. Red Hat may review the terms of use at any time without notice. The revised terms of use take effect when they are published. Your continued use of a Red Hat portal after changes to the terms of use are published and your mandatory acceptance of the updated terms of use. If the terms of use are no longer acceptable to you, you should stop using Red Hat content immediately. These terms of use, as well as your customer agreement (and, if applicable, additional terms and licensing agreements) constitute the entire legal agreement between you and Red Hat and govern your use of Red Hat content and replace all previous agreements between you and Red Hat regarding Red Hat content. You agree that Red Hat may provide you with communications, including changes to terms of use, by email or ad on Red Hat Portals.

If one or more of the provisions contained in the terms of use are declared invalid or unenforceable by a competent court, this position will not affect the validity, legality or applicability of the other provisions. Red Hat`s failure to exercise or enforce any right or provision of these Terms of Use does not constitute a waiver of that right or provision. The heading of these terms of use is for simplicity and has no legal or contractual effect. Your use of the Software is subject to the terms of an end-user license agreement and/or other agreements between you and Red Hat and/or third parties („Licensing Agreement“). Licensing agreements (i) for Red Hat Subscription Software (which is defined as software (including updates) that Red Hat must contractually provide to you under the terms of your customer contract are included in your customer contract or booked (ii) for additional software (defined as software that Red Hat provides to you in addition to Red Hat subscription software) when you download or access additional software.
